The user will not have any claim regarding information published on the website, and the operator will not bear any responsibility towards the user regarding information published on the website and/or information received by a third party through the website, including any information uploaded by advertisers.

The advertiser will have no claims against the operator, who will not bear any responsibility for false information presented to him by users who contact him as a result of using the website, including for any damage caused to him by users who contact him through the website, in part for the purpose of contacting him regarding the offer, and any contact that may be to him with users as mentioned. And it should be emphasized that any interaction between a user and an advertiser following the publication of an advertising article on the website will be concluded directly between the user and the advertiser and it does not include the operator and/or anyone on its behalf as a party to the transaction.

The operator does not guarantee that the links on the website and/or within the mailings sent to the user will be correct and will lead to an active website. The presence of a certain link on the website does not mean that the content of the website is reliable and/or complete and/or up-to-date, and the operator will not bear any responsibility in connection therewith. Without detracting from the above, the operator is not responsible for any damage, indirect or direct, that may be caused to the user and/or his property as a result of using and/or relying on the information and content appearing on the websites he reached through or through the use or link existing on the website.

It is possible that the services on the site will be interrupted and/or accompanied by errors and/or will not be provided as they should be without breaks and interruptions. The operator will not bear any responsibility, of any kind, for any damage, direct or indirect, caused to the user and/or advertiser and/or any third party, or to their purchase as a result.

The information and services available as part of the service provided on the website may include inaccuracies or typographical errors. The operator does not undertake and does not declare that the service will be uninterrupted or error-free, or that an error will be corrected, or that the service or the server providing the service will be free of viruses or other harmful components. The operator does not guarantee and/or declare that the use or the results of the use of the service or the materials provided through the service will be accurate, correct, reliable or trustworthy in any way.

The user expressly agrees that the operator will not be responsible in any way due to unauthorized access or changes made to the user’s information, whether sent or received by him or not.

The operator is not responsible for the content of commercial offers of third parties that appear on the website, including commercial offers made by advertisers. Any claim, claim or demand on the part of a user regarding offers he received from advertisers on the website will be directed by him directly to the third party, including the advertiser from whom he received an offer, and he will not have any claim or demand against the operator and/or anyone on its behalf.

While utilizing Paywolf services, users are responsible for ensuring that they do not violate any terms of service set forth by third parties or any country’s laws. In the event of such a violation, neither Paywolf nor its officers, employees, agents, and sub-contractors shall be held accountable.

By accepting these terms, you also commit to defending, indemnifying, safeguarding Paywolf, its officers, employees, agents, sub-contractors, and affiliated entities from any and all claims, responsibilities, losses, expenses, and demands, including reasonable legal fees, brought against Paywolf, its agents, customers, officers, and employees, whether directly or indirectly linked to services provided, performed, or agreed upon, or to any products sold by you, your agents, employees, or assigns.

Limitation of liability

Unless otherwise explicitly stated and without prejudice to applicable statutory product liability provisions, Users shall have no right to claim damages against the Owner (or any natural or legal person acting on its behalf).

This does not apply to damages to life, health, or physical integrity, damages resulting from the breach of an essential contractual obligation such as any obligation strictly necessary to achieve the purpose of the contract, and/or damages resulting from intent or gross negligence, as long as this Website has been appropriately and correctly used by the User.

Unless damages have been caused by way of intent or gross negligence, or they affect life, health or physical integrity, the Owner shall only be liable to the extent of typical and foreseeable damages at the moment the contract was entered into.

In any event of liability, the compensation may not exceed the total payments that have been, will be or would be received by the Owner from the User based on the contract over a period of 3 months, or the period of the duration of the Agreement, if shorter.

Nothing in these Terms excludes, restricts, or modifies any guarantee, condition, warranty, right or remedy that the User may have under the Competition and Australian Consumer Act 2010 (Cth) or any similar State and Territory legislation and which cannot be excluded, restricted or modified (non-excludable right). To the fullest extent permitted by law, our liability to the User, including liability for a breach of a non-excludable right and liability which is not otherwise excluded under these Terms of Use, is limited, at the Owner’s sole discretion, to the re-performance of the services or the payment of the cost of having the services supplied again.

For USA Clients The Service may become inaccessible or it may not function properly with Users’ web browsers, mobile devices, and/or operating systems. The owner cannot be held liable for any perceived or actual damages arising from Service content, operation, or use of this Service.

Federal law, some states, and other jurisdictions do not allow the exclusion and limitations of certain implied warranties. The above exclusions may not apply to Users. This Agreement gives Users specific legal rights, and Users may also have other rights which vary from state to state. The disclaimers and exclusions under this agreement shall not apply to the extent prohibited by applicable law.

Content Liability

We shall not be held responsible for any content that appears on your Website. You agree to protect and defend us against all claims that are rising on your Website. Engagement with advertisers and the advertisers’ commitment

When the user enters the site, the user will be able to view various advertising articles as uploaded by the advertisers. It will be clarified that the selection of articles changes from time to time according to the choice of each advertiser, and the user will not have a claim for changing the variety of articles as mentioned. For the avoidance of doubt, the articles are uploaded by the advertisers and not by the operator and the operator has no control over the uploading of articles by the aforementioned advertisers who are not related to the operator.

The user declares that he is aware that the operator does not necessarily check the articles that appear on the website and does not necessarily verify all the information that appears by the advertiser and/or anyone on his behalf on the website and the user will have no claims against the operator due to any discrepancy that results in false information received from any advertiser on the website. This does not detract from the operator’s right to verify, test and/or filter content uploaded by advertisers as it deems appropriate to do so.

A user engagement that will be made following the publication of an advertising article by an advertiser on the website and/or following the user’s use of the website will be concluded directly between the user and the advertiser, and it does not include the operator or anyone on its behalf as a party to the transaction or as responsible for it, even if information between the parties is transmitted through the operator itself. For the avoidance of doubt, it will be clarified that the operator serves as an advertising board and as a platform only for the publication of advertising articles by advertisers.

Although the user contacts the advertiser through the website, the operator serves only as a platform and is therefore not responsible for the content that appears on behalf of the advertisers who upload advertising articles on the website, and it is the user’s responsibility to verify all the details relevant to the advertising matter in which he is interested, including the content and viability of the offer that appears in the article. Any claim, claim or demand that the user may have regarding offers he received as a result of a letter he was exposed to on the website will be directed by him directly to the third party, including the advertisers from whom the user received the offer, and he will not have any claim or demand against the operator. It will be clarified that the operator does not have any ability to examine all the information about the advertisers and advertising articles on the site, and therefore it is not able to carry out the screening and ensure compliance with these conditions.

In any case of publication of false information by advertisers, the user is requested to inform the operator whose details appear in these terms of use.

The following conditions will apply to the advertisers, in addition to the other terms of use and without detracting from what is stated therein.

The advertiser declares and undertakes that all the information in the article that will be published on the site by him corresponds to the proposed publication and that if there is a change in the nature and/or the conditions of the offer appearing in the article and/or if the content of the article is not relevant, then it will be updated and/or removed immediately accordingly. Meanwhile, the advertiser undertakes not to publish fictitious articles.

The advertiser undertakes that the content of the article published by him will comply with the provisions of the law and that such an article will not include false information.

The operator may take action against an advertiser who violates any of his above obligations, including but not limited to removing his messages, all or part of them, and even blocking him from using the site without any prior notice and in accordance with his discretion, and the advertiser will have no claims against the operator for this.
